An Advance Health Care Directive or Living Will, is a legal document in which an individual nominates an “Agent” to act on his or her behalf in making health care decisions in the event the individual becomes incapacitated. An advance directive also allows an individual to make decisions about end-of-life care, organ donation, and even burial or cremation instructions.
Without a California Advance Health Care Directive, loved ones must make health care decisions for an incapacitated individual without knowing their wishes. In the event family disagrees on medical decisions, they must petition the California Probate Court for a conservator to be appointed.
